JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-06-2019 This is an application for grant of anticipatory bail in connection with Trial No.3243 of 2018 (arising out of Complaint Case No.573 of 2018), disclosing offence under Section 498-A of the Indian Penal Code.

Allegation against the petitioner is of torturing his wife with respect to demand of dowry.

Submission of the learned counsel for the petitioner is that as a matter of fact, sister of the petitioner was kidnapped by the brother of the complainant, due to that a case has been lodged in that concerned and due to that reason, the present case has been lodged and he is still ready to pay the maintenance amount to the complainant.

Patna High Court CR. MISC. No.20905 of 2019(3) dt.19-06-2019 2/2 Heard learned A.P.P. as well as learned counsel for the opposite party no.2 also, who has submitted that she is still ready to reside with the petitioner.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M.-1st, Bagaha, West Champaran, in connection with Trial No.3243 of 2018 (arising out of Complaint Case No.573 of 2018), subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.

This is further subject to condition that if any maintenance case is filed by the opposite party no.2, the petitioner shall cooperate with the disposal of the same and abide by any interim order or final order passed by the Family Court.
