The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 366A/34 of the Indian Penal Code.

As per prosecution case, the informant alleged that his two daughters were gone missing thereafter he came to know that the petitioner along with co-accused had enticed away their daughters with intention to marry them. After that the informant has lodged this case regarding abduction of his daughters. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case due to dirty village politics. Both the victims were recovered and their statement has been

Patna High Court CR. MISC. No.26927 of 2023(3) dt.24-07-2023 2/2 recorded u/s 164 of the Cr.P.C. in which both the victims were specifically stated that they went to Delhi with the petitioner and co-accused where they solemnized marriage out of their own sweet will. The victims have not stated any complicity of the petitioner. It is also submitted that good sense has been prevailed between the parties. The petitioner has got no criminal antecedent as stated in para-3 of the petition. Moreover, he is languishing in judicial custody since 17.1.2023. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Teghra P.S. Case No. 203 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai.
