The petitioner is apprehending his arrest in connection with Kotwa P.S. Case No. 151 of 2018 for the offence registered under Sections 147, 148, 149, 341, 323, 324, 325, 307, 354(B), 379 and 302 of the Indian Penal Code.

Learned counsel for the petitioner submits that the main allegation against this petitioner is of having attacked one Manoj Paswan, who is not the deceased, on the arm with an iron rod causing a fracture. It is further submitted that there is no premeditation and the petitioner is having no criminal antecedent.

Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent, let

No.23451 of 2019(4) dt.12-07-2019 2/2 the petitioner, above named, in the event of his arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-X, East Champaran at Motihari in connection with Kotwa P.S. Case No. 151 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
