JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The looted motorcycle is said to have been recovered from the house of the petitioner but submission on behalf of the petitioner is that the confessional statement of co-accused goes to show that the looted motorcycle had been given to the petitioner to conceal the aforesaid motorcycle in his house and, as a matter of fact, one co-accused, being neighbour of the petitioner, came to the house of the petitioner and requested him to keep the motorcycle in his house. It is further submitted that petitioner was not aware of this fact that the aforesaid motorcycle was looted property. Moreover, petitioner does not have any criminal antecedent and is languishing in jail custody since 19.08.2016. Considering the aforesaid facts and circumstances as
