The petitioner seeks regular bail in Sanhaula P.S. Case No. 135/2018, registered for the offences punishable under Sections 406, 420, 467, 468, 471 and 120(B) of the Indian Penal.
Learned counsel for the petitioner has submitted that there is no recovery of any incriminating article from possession of this petitioner. Incriminating article has been recovered from possession of the co-accused Subhash Sah. This petitioner has been implicated in this case because he was driving the vehicle along with Subhash Sah. Subhash Sah has taken the name of petitioner in his confessional statement. He is in custody since 18.09.2018 having clean antecedent.
Patna High Court Cr.Misc. No.74389 of 2018(2) dt.12-12-2018 2/2 Considering the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above-named, be released on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Sanhaula P.S. Case No. 135/2018, subject to the condition that both the bailors will be close relative of petitioner.
