Since the physical court proceeding is non-functional, due to present pandemic COVID-19, the matter is listed with defects.
Learned counsel for the petitioner undertakes to remove the defects within three weeks of resumption of physical court proceeding. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.
The petitioner seeks bail in a case registered for the offence punishable under Sections 147, 148, 149, 302, 120(B) of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.26421 of 2020(2) dt.12-10-2020 2/2 allegation of firing is not against this petitioner but against Suraj Sarkar. He submits that the petitioner is not named in the FIR but on the confessional statement of co-accused name of the petitioner has come in this case. He submits that similarly situated co-accused have been granted the privilege of bail by coordinate Benches of this Court in Cr. Misc. No. 68879 of 2019 on 06.02.2020 and in Cr. Misc. No. 69384 of 2019 on 27.11.2019. He further submits that petitioner bears no criminal antecedent as stated in para-3 of the bail petition and he is languishing in judicial custody since 20.12.2019. In the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-III, Patna in connection with Rajiv Nagar Police Station Case No. 355 of 2019.
