NATH ORAL ORDER 21-01-2015 Heard the learned counsel for the petitioners. Nobody appears on behalf of the State of Bihar.

The petitioners are apprehending their arrest in connection with Barachatti P.S. Case No. 309 of 2013 for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code.

The petitioners are the father-in-law and mother-in-law of the deceased lady and in the First Information Report lodged by the brother of the deceased lady, there is direct allegation of killing the said lady who was their daughter-in-law. It has also been stated that the deceased lady has left behind a son aged about three years and a daughter aged about one year.

Patna High Court Cr.Misc. No.31557 of 2014 (2) dt.21-01-2015 The learned counsel for the petitioners has submitted that though some hot talks were there in the family but the petitioners have not committed the aforesaid crime and they have been falsely implicated. It has also been submitted that there would be no one take care of the minor children left behind by the deceased lady.

From the order passed by the learned Sessions Judge, it appears that the investigation is still going on. After considering the facts and circumstances of the case and the submissions, this Court is not inclined to grant the anticipatory bail.

Accordingly, the prayer of the petitioners for grant anticipatory bail is rejected in connection with Barachatti P.S. Case No. 309 of 2013 pending in the court of the learned Sub Divisional Judicial Magistrate, Sherghati, District-Gaya. (V. Nath, J) Devendra/- U T
