JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-12-2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Dumraon P. S. case no. 273/2018 registered under sections 379/414 of the IPC, section 11 of Animal Cruelty Act, various sections of Bihar Animal Transportation Rule as well as section 3 of Bihar Animal and Empowerment of Animal Act. Petitioner is named in the first information report but admittedly, petitioner is owner of the truck on which cows were being carried. However, submission on behalf of the petitioner is that first information report itself goes to show that the allegation of smuggling of aforesaid cows was levelled against other accused persons and not against the petitioner.
