The petitioner seeks bail in Assaon P.S. case No. 58 of 2018 registered under Section 457/380 of the Indian Penal Code.

The informant lodged the case against unknown for theft of idols of god and goddess.

Learned counsel for the petitioner submits that petitioner is not named in the FIR. The only witness Suresh Gond did not name the petitioner and name of petitioner was figured in the confessional statement of Mukesh Rai and save and except confession there is no material against the petitioner. The petitioner is in jail since 27.06.2018 but he has not been put in T. I. Parade. Similarly situated accused Alok Kumar and Manish Kumar Singh have already been granted bail.

No.73637 of 2018(2) dt.12-12-2018 2/2 Considering the facts aforesaid and nature of allegation made against the petitioner, the petitioner, above named, is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the lime amount each to the satisfaction of learned Judicial Magistrate, 1st class, Siwan in connection with Assaon P.S. case No. 58 of 2018.
