1. The State of Bihar .... Opposite Party ====================================================== Appearance :
For the Petitioners : Mr. Bijay Bhushan Prasad, Adv. For the Opposite Party : Mr. Ahtash Ali Khan, APP 4 ====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 01-07-2017 Heard the learned counsel for the petitioners and the State.
This is a petition for grant of anticipatory bail for offence under Sections 147, 148, 149, 341, 323, 324, 307, 354, 379, 447, 504 and 506 of the Indian Penal Code. For land dispute, the petitioners allegedly assaulted with lethal weapon causing injury on the vital parts of the body of the victim.
Submission of the learned counsel for the petitioners is that the doctor has found simple injuries. There is case and counter case. Both sides have sustained serious injuries. Considering the fact that the petitioners had knowledge that their act might cause death of the informant, I am not inclined to enlarge the petitioners on anticipatory bail. The prayer for anticipatory bail is refused.
In the event of surrender of the petitioners and pray for regular bail, the same shall be disposed off without being prejudiced of this order.
