JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-05-2019 Petitioners seek bail in anticipation of their arrest in connection with Kotwali (Jogsar) P.S. Case No. 792 of 2018 registered for the offences punishable under Sections 147, 148, 341, 323, 379, 384, 427 and 506 of the Indian Penal Code. Allegation against the accused persons, including the petitioners is of demanding extortion from the informant, who is running a shop, and on refusal they have snatched 15-16 thousand rupees from the cash box.

Submission of learned counsel for the petitioners is that they are only named in the FIR and the main allegation is against one Palatu Yadav and further petitioners have no criminal antecedent.

In view of above facts and circumstances, let petitioners surrender within a period of six weeks from the receipt of this order and on surrender they shall be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur, in connection with Kotwali (Jogsar) P.S.Case No. 792 of 2018, corresponding to G.R.No. 6287 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition is that if their names appear in such type of case in future, the prosecution is at liberty to move the court below for cancellation of their bail bonds.

Let a copy of this order be sent to the Sr.Superintendent of Police, Bhagalpur for needful.
