JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 05-08-2022 At the outset, learned counsel for the petitioners submits that petitioner no. 1 namely Ranjeet Ram has been arrested and as such, he seeks permission to withdraw this petition, so far as petitioner no. 1 is concerned. Accordingly, in respect of petitioner no. 1, this anticipatory bail petition is dismissed as withdrawn. Heard learned counsel for the parties through video conferencing.

The petitioner no. 2 apprehends his arrest in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

Patna High Court CR. MISC. No.24796 of 2022(2) dt.05-08-2022 2/2 the house of co-accused Govind Ram and co-accused Govind Ram, Sudhansu @ Moti and this petitioner no. 2 are alleged to have fled away from the place of recovery.

It is submitted on behalf of petitioner no. 2 that nothing has been recovered from his possession and he has got no concern with the seized liquor and has got clean antecedent. Considering the nature of allegation and clean antecedent, let the above named petitioner no. 2, in the event of his arrest or surrender within a period of six weeks from the date of receipt / production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. II, Muzaffarpur / concerned court in connection with Piar P.S. Case No. 216 of 2021, subject to conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Singh, J) anay/- U T
