2. The petitioner has preferred this application for grant of regular bail in connection with Paharpur P.S. Case No. 519 of 2024, dated 20.11.2024 registered for the offences punishable under Sections 111, 317(3), 317(5) and 61(2) of the B.N.S. and under Sections 25(1-B)a, 26 and 35 of the Arms Act.
3. As per the prosecution case, during the course of vehicle checking at Ibrahimpur village, one Bolero and one pick up van were stopped and checked. It is further alleged that from the said vehicles one iron wire cutter, plastic slippers, electric wire, a country made pistol, live cartridges, scissor cutter machine, one iron frame, big bundle of aluminum wire weighing 350 kg, mobile phones and a pair of shoes were

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that on the request of the owner of the vehicle, who is a contractor, the petitioner was driving the said Bolero for a wedding ceremony. Nothing has been recovered from the conscious possession of the petitioner. The co-accused person namely, Ankit Kumar has already been granted bail by a Co-ordinate Bench of this Court vide order dated 16.04.2025 passed in Cr. Misc. No. 17986 of 2025. The petitioner has clean antecedent as stated in paragraph no. 3 of the bail petition. The petitioner is in custody since 21.11.2024.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as petitioner's period of custody, the petitioner, above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IX, East Champaran, Motihari, in connection with Paharpur P.S. Case No. 519 of 2024, on further conditions:

No.23047 of 2025(2) dt.29-04-2025 3/3 (I) The petitioner is directed to remain physically present before the learned trial Court on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled. (II) The petitioner is directed to cooperate in the trial before the learned trial Court.
