JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-395, 379, 412 of the Indian Penal Code. Petitioner was neither caught on the spot nor anything was recovered from his conscious possession and it is obvious from perusal of the first information report that the name of petitioner came in confessional statement of co-accused persons who were caught after the alleged occurrence. Moreover, the petitioner does not have any criminal antecedent nor he has been put on Test Identification Parade.

Considering the above-said facts and circumstances

Patna High Court Cr.Misc. No.38606 of 2016 (2) dt.17-09-2016 2/2 of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Barachatti P.S. Case No. 511 of 2013 to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati, Gaya.
