The petitioner seeks bail in connection with Tatarpur P. S. Case No. 94 of 2017 instituted for the offence under Section(s) 420 of the Indian Penal Code and 66 of I.T. Act. Learned counsel for petitioner submits that FIR is against unknown.
In the written report it is alleged that when the informant was withdrawing the money from ATM an unknown person standing behind her asked to help her. Thereafter, the unknown person withdrew the money from the Bank account of the informant.
The police has made this petitioner accused in this case during investigation while he was in custody in another
Patna High Court Cr.Misc. No.74394 of 2018(2) dt.13-12-2018 2/2 case. No T.I.P. has been held. There is no recovery of incriminating article from his possession.
Petitioner is in custody since 17.11.2017 Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VII, Bhagalpur in connection with Tatarpur P.S. Case No. 94 of 2017, subject to the condition that both the bailers shall be the close relative of the petitioner. (Sanjay Priya, J) shyambihari/- U T
