Learned counsel for the petitioner is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.
This application for anticipatory bail arises out of Musahari P.S. Case No. 196 of 2021 registered for the offences under Sections 272 and 273/34 of the Indian Penal Code and under Section 30(a) of the Bihar Prohibition & Excise (Amendment) Act, 2016.
Considering the quantum of liquor recovered from the motorcycle and also the fact that the petitioner has clean antecedent, this anticipatory bail application is allowed. Let the petitioner, above named, in the event of his arrest/surrender within four weeks from today in the Court
Patna High Court CR. MISC. No.23161 of 2022(2) dt.13-05-2022 2/2 below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court No.1, Muzaffarpu, in connection with Musahari P.S. Case No. 196 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is also subject to the condition that the petitioner shall mark his attendance in the Musahari Police Station, District- Muzaffarpur, on first Sunday of every month during the course of the pendency of the case. In default in making his attendance in the aforesaid Police Station, will result into cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) pawan/- U T
