JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-04-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 452, 332, 333, 435, 436, 337, 338, 323, 224, 225, 307, 153(A), 342, 160, 379, 120-B and 353 of the Indian Penal Code.

Although the petitioner is named in the first information report but no specific overt act has been attributed against him and the present case was lodged against more than one hundred one named persons as well as near about two thousand unknown persons, when a mob attacked the police station and set several vehicles of police station on fire. Petitioner is in jail custody since 21.1.2019 and except the present and one Ramgarh P.S. Case No. 15 of 2019, which was registered for the offence on the same day, the petitioner

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Mohania, in connection with Ramgarh P.S. Case No. 16 of 2019.
