JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-07-2019 Petitioner seeks bail in anticipation of his arrest in connection with Siswan (Chainpur O.P.) P.S. Case No. 23 of 2019 registered for the offences punishable under Sections 467, 468, 420, 471 of the Indian Penal Code and Sections 63/65 of the Copy Right Act.

Prosecution story is Block Development Officer found an abandoned truck bearing registration No. UP-52-5275 laden with 15 ton of cement contained in 300 bags, out of which 225 bags were of J.P. Cement and 75 bags of Bagur Cement and on inquiry it was found that the same were purchased by Sankat Mochan Enterprises and it further appears that the same were purchased on lower price than market price and it was also found that Sankat Mochan Enterprises has no godown. It is alleged that petitioner being the proprietor of said Sankat Mochan Enterprises purchased the damaged cement for its use.

No.26500 of 2019(3) dt.08-07-2019 2/2 Submission of learned counsel for the petitioner is that as a matter of fact he purchased the same for the purpose of making bricks and one dishonest person demanded extortion from him and as such the false case has been filed. Further submission is that the firm is registered and he has valid business licence and as such there is no chance of absconding of the petitioner from the investigation. Heard learned APP also.

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender before the court below within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-IV, Siwan, in connection with Siswan (Chainpur O.P.) P.S. Case No. 23 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition is that petitioner has to co-operate in the investigation.
