The petitioner seeks bail in Bhabhua (Sonhan) P.S. Case No. 330 of 2016 registered under Sections 366A/34 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in this case and as a matter of fact the statement recorded by the doctor shows that the victim girl has denied the allegation made against the petitioner and the petitioner is in jail since 06.07.2016. It has also been submitted that the other accused persons have been granted anticipatory bail vide order dated 19.09.2016 passed in Cr. Misc. No. 39738/2016.

No.55196 of 2016 (2) dt.09-01-2017 2/2 Having heard both sides and in view of the fact that the victim girl in her statement under Section 164 Cr.P.C. has named the petitioner and alleged that she was kidnapped as well as raped by the petitioner and other persons, as such, I am not inclined to enlarge the petitioner on bail in Bhabhua (Sonhan) P.S. Case No. 330/16. Accordingly, the prayer for bail of the petitioner is rejected.
