This is a petition for grant of regular bail for offence under Section 304/34 of the Indian Penal Code. Deceased, Pramod Kumar, the brother of the informant was driver of Bolero vehicle of co-accused, Birju Rai. He did not return to his house and subsequently his dead body was found, hence, petitioners and others are suspected to have committed his murder.

Submission is that co-accused, Birju Rai, Yadunath Rai and Ajit Rai, have already been allowed bail in Cr. Misc. No. 25827 of 2014 on 22.09.2014. Allegation against the petitioners is of similar footing.

Considering the aforesaid fact, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with Tajpur (Halai O.P.) P.S. Case No. 28 of 2014 to the satisfaction of the Additional Chief Judicial Magistrate, I, Samastipur, or successor Court. (Birendra Kumar, J) SA/- U √ T √
