This is a petition for grant of anticipatory bail for offence under Section 47(a) and (F) of the Bihar Excise Act.

Allegation is that huge quantity of country made liquor was recovered from the field side and allegation is that the same was of the petitioner. Submission of the petitioner is that copy of the seizure list was not supplied to any of the family members of the petitioner nor the seizure list was produced to the Court at the earliest rather produced after four months. The petitioner has stated on oath that he has got no criminal antecedent and the offence was alleged committed under the old Act.

No.22023 of 2017 (2) dt.18-05-2017 2/2 Considering the aforesaid fact, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with G.O. Case No. 584 of 2014 to the satisfaction of the Chief Judicial Magistrate, Nawadah, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
