The petitioner seeks bail in a case instituted for the offences under Sections 20 and 22 of the N.D.P.S. Act. The prosecution case is that 71.9 kg. Ganja is recovered in this case from the accused persons. It has been submitted on behalf of the petitioner that the petitioner is in custody since 30.9.2018. There is no allegation of tampering of witnesses alleged against the petitioner. Charge-sheet has been submitted in the present case. There is no recovery of any contraband from the possession of the petitioner. The recovery is said to have been from the house of co-accused Chandan Sharma. The name of the petitioner has transpired on the basis of confession of co-accused.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum- Special Judge, N.D.P.S. Act, Purnea in connection with Special Case No. 13/2018 arising out of Mirganj P.S. Case No. 102/2018.
