The petitioner is apprehending his arrest in connection with Gogri P.S. Case No. 225 of 2015 for the offences instituted under Sections 143, 341, 283 and 353 of the IPC. The prosecution story, in brief, is that on 02.08.2015 at 8.00 A.M., under the leadership of the petitioner, 100 to 150 persons staged Dharna and procession in front of the residence of S.D.M. Gogri and thereby put hindrance in official work and communication.

It has been submitted on behalf of the petitioner that the petitioner was granted bail by the police.

Considering the aforesaid facts and circumstances of the

Patna High Court Cr.Misc. No.46678 of 2015 (3) dt.01-02-2016 2/2 case, the anticipatory bail application of the petitioner is not maintainable in connection with Gogri P.S. Case No. 225 of 2015, pending in the court of the learned C.J.M. Khagaria. Anyhow, if the petitioner surrenders in the learned court below within a period of six weeks from the date of receipt/production of copy of this order the same shall be considered without being prejudiced by this order in view of ratio laid down in the case of Mahendra Prasad Singh Vs. The State of Bihar reported in 2004(3) P.L.J.R. 491.
