JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-363, 366(A), 120(B)/34 of the Indian Penal Code and Sections-4 & 6 of the POSCO Act.

The statement of victim was recorded u/S 164 of the Cr.P.C. in which, she disclosed a different story and stated that she was never kidnapped rather she had gone along with the petitioner to Benglore by her own volition. The victim disclosed her age as 18 years though the learned Magistrate assessed her age as 17 years.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs.

Patna High Court Cr.Misc. No.46471 of 2016 (2) dt.24-10-2016 2/2 10,000/- (ten thousand) with two sureties of the like amount each in connection with POSCO Case No. 29 of 2016 arising out of Begusarai Town P.S. Case No. 151 of 2016 to the satisfaction of learned Special Judge, POSCO Act, Begusarai.
