Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 406 and 506/36 of the Indian Penal Code and Section 138 of the N.I.Act, registered in connection with Complaint Case No. C-1563 of 2019. As per allegation, the present petitioner and his son Amit Kumar Singh entered into a contract with the complainant, who is the owner of electric shop. The son of the present petitioner gave a cheque of Rs. 4,50,000/- to the complainant which was dishonoured due to insufficient amount in the account.

The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.31675 of 2021(2) dt.21-03-2022 2/2 that the cheque was not issued by the present petitioner, rather it was issued by co-accused Amit Kumar Singh, who has been granted bail by the court below.

Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Kumari Jyotsna, learned Judicial Magistrate 1st Class, Motihari, East Champaran in connection with Complaint Case No. C-1563 of 2019, subject to the conditions as laid down under Section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
