JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 25-07-2017 Heard learned counsel for the petitioner, learned counsel appearing on behalf of informant and the learned A.P.P. for the State. The petitioner apprehends his arrest in connection with C.R. Case No. 778 of 2014, T.R. No. 6179 of 2014, registered under Section 498-A of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
Learned counsel for the petitioner and O.P. No.2 submits that the matter was referred to Mediation Centre, Patna High Court for settlement of the dispute between the parties. It has been reported by the Mediator that the dispute between the parties has been resolved and they decided to live separately and as final settlement, petitioner will pay Rs. One lakh out of which Rs. 49,000/- has already been paid by the petitioner to the O.P. No.2 and remaining amount of Rs.
Patna High Court Cr.Misc. No.5682 of 2017 (4) dt.25-07-2017 2/2 52,786/- will be paid by the petitioner within six months. Learned counsel appearing on behalf of O.P. No.2 submits that dispute between the parties has been settled and petitioner & O.P. No.2 are also ready to withdraw all the cases pending against them.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Samastipur in connection with C.R. No. 778 of 2014, T.R. No. 6179 of 2014, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
