JUSTICE ANIL KUMAR SINHA ORAL ORDER 09-11-2020 Heard Mr. Shailendra Kumar Singh, learned counsel for the petitioner and Mr. Akshay Lal Pandit, learned Additional Public Prosecutor appearing for the State through video conferencing.

Petitioner seeks regular bail in connection with Karjain P.S. Case No. 79 of 2019 registered for the offence punishable under Section 379 of the Indian Penal Code 1860.

The allegation against the petitioner is that he along with other accused persons has stolen a sum of Rs.5,00,000/- from the dickey of the Motorcycle. Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner

Learned counsel further submits that similarly situated coaccused Manish Kumar Yadav has been granted regular bail by a co-ordinate Bench of this Court vide order dated 04.11.2019 passed in Cr. Misc. 65106 of 2019. The petitioner is in custody since 06.11.2019 i.e. for about more than one year.

Having heard learned counsel for the parties and taking into consideration the materials on record, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.20,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri B. Bhushan, learned Judicial Magistrate, 1st Class, Birpur (Supaul) in connection with Karjain P.S. Case No. 79 of 2019 subject to the following conditions:- (i) that one of the bailors will be father/mother of the petitioner. The bailor will also undertake to inform the court if there is any change in the address of the

(ii) that the petitioner will be well represented on each date in the trial and if he fails to do so on two consecutive dates, his bail bonds will be liable to be cancelled.

It is made clear that at the time of furnishing bail bonds all the parties shall follow the guidelines regarding social distancing.
