The petitioner apprehends her arrest in a case registered for the offences punishable under Sections 302, 201, 120B and 34 of the Indian Penal Code and under Section 27 of the Arms Act. The informant, father of the deceased Mohan Kumar Pandey lodged the case against unknown on the basis of information given by Abhiranjan Kumar @ Amit. The petitioner is not named in the FIR. During the course of investigation, the informant suspected the hands of Abhiranjan Kumar @ Amit and others including the petitioner. 24 hours earlier, the petitioner had altercation with the deceased for plucking flowers and the petitioner had threatened the deceased to kill him within 24 hours. It is submitted that except suspicion the police did not

Patna High Court Cr.Misc. No.47580 of 2015 (4) dt.26-11-2015 2/2 collect any material that the petitioner ever conspire with any of the accused persons to kill the deceased Mohan Kumar Pandey. Learned counsel for the informant has submitted that there is call details also and anticipatory bail petition of the accused Sanjay Singh @ Basuri has already been rejected. It appears that save and except suspicion, no tangible material is collected against the petitioner even the petitioner was not found talking with any other accused persons. The petitioner is a lady.

Considering the facts aforesaid, the petitioner above named, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Shri D.K. Mishra, the learned Judicial Magistrate 1st Class, Patna City, Patna in Shahjahanpur P.S. Case No. 63 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
