JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-02-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 341, 307, 326 of the Indian Penal Code.
As per the prosecution case, this petitioner poured kerosene oil on the body of victim and set her on fire as a result of which she sustained severe burn injuries and died during treatment.
Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. The informant is not an eye witness of the occurrence and during the course of patrolling he came to know from the villagers about the occurrence. Petitioner claims clean
Patna High Court CR. MISC. No.30597 of 2021(5) dt.21-02-2022 2/2 antecedent and is in custody since 04.02.2021 and investigation in this case is complete.
Learned counsel appearing for the State opposes the prayer for bail and submits that there is direct and specific allegation against this petitioner that he poured kerosene oil on the victim and set her on fire and the victim died during the course of treatment. The post mortem report also corroborates the prosecution case as the doctor found the cause of death due to burn injuries.
Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.
