JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 13-07-2017 Heard Mr. Mishra for the petitioners and the APP for the State. Apprehending their arrest in Sarairanjan P.S. Case No. 261 of 2016 registered under section 307 IPC, the petitioners have filed the present application for grant of anticipatory bail.

It is submitted that the allegation of assault on the informant and Mukesh Kumar is general and omnibus. The specific allegation of assault on Sajjan Jha by Farsa is attributed to the co-accused Baijnath Mahto. Owing to land disputes evidenced from the FIR, the occurrence had taken place. The petitioners do not carry any criminal antecedents. Considering the above, let the petitioners named above, in the event of arrest/surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of A.C.J.M. VI, Samastipur in Sarairanjan P.S. Case

Patna High Court Cr.Misc. No.24944 of 2017 (2) dt.13-07-2017 2/2 No. 261 of 2016 on condition that one of the bailors of each of the petitioners shall be their own/close family members. As soon as the charges are framed, they shall appear personally in the court below on each and every date fixed thereat. In case of default in appearance on two consecutive dates, the trial court shall have liberty to cancel their bail bonds and secure their arrest in accordance with law.
