Petitioner seeks bail in Excise Case No.418 of 2017, arising out of Jehanabad P.S. Case No.100 of 2015, registered under Sections 272 and 273 of the Indian Penal Code and under Section 47(A) of the Excise Act.

The informant got information about the existing of illegal liquor Bhatii in village Mathiyapur. On such information the informant and other police official raided the place and found 10 liuqor Bhatti and the villagers disclosed the name of the petitioner and other accused persons that they were manufacturing country made liquor.

Learned counsel for the petitioner submits that nothing has been recovered from the conscious possession of

Patna High Court Cr.Misc. No.75670 of 2018(2) dt.18-12-2018 2/2 the petitioner. Petitioner is in jail since 09.07.2018. Similarly situated other accused person, namely, Binod Yadav has already been enlarged on bail.

Considering the facts aforesaid and the fact that the petitioner is in jail for more than five months, petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II, Jehanabad in connection with Excise Case No.418 of 2017, arising out of Jehanabad P.S. Case No.100 of 2015.
