The petitioner seeks bail in connection with Banka Excise Complaint Case No. 144 of 2023 registered for the offence under Section 30(a) of Bihar Prohibition & Excise Act 2016.

Learned counsel for the petitioner submits that the petitioner is in custody since 15.02.2023, petitioner has clean antecedent and there is recovery of 102.600 liters of illicit foreign made liquor.

Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the period of custody, clean antecedent

Patna High Court CR. MISC. No.23927 of 2023(2) dt.15-05-2023 2/2 and the recovery of liquor, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl.
