JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report and the present case was lodged against unknown but in course of investigation, it came to light that the victim had sweet relation with one Pratibha Kumari @ Ujala Kumari. Subsequently, the aforesaid Pratibha Kumari @ Ujala Kumari and her brother, namely, Mungeri Lal Ojha, were interrogated and the aforesaid Mungeri Lal Ojha disclosed the name of petitioner stating therein that the petitioner used to oppose the relation of Pratibha Kumari @ Ujala Kumari and deceased. Moreover, the investigation against the petitioner has already been completed and except the aforesaid material and so called confessional statement, there is nothing against the petitioner.

No.46169 of 2016 (3) dt.02-12-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Danapur in connection with Paliganj P.S.Case No. 57 of 2016.
