The petitioners apprehend their arrest in connection with Complaint Case No.3611 of 2010/Tr. No.889 of 2018 registered under Sections 498(A), 379 and 323 of the Indian Penal Code besides Section 4 of the Dowry Prohibition Act, pending in the court of the Sub Divisional Judicial Magistrate, Hajipur, Vaishali.
The accusation is of torturing the opposite party no.2
Patna High Court CR. MISC. No.22099 of 2019(4) dt.02-07-2019 2/2 by her husband and other in-laws for non fulfillment of the dowry demand and also removing the opposite party no.2 from the matrimonial house along with her baby by snatching her personal belongings.
Learned counsel for the petitioners submits that the petitioners are father-in-law, mother-in-law, sister-in-law and cousin sister-in-law of the opposite party no.2 and they have falsely been implicated in this case. The petitioners have no criminal antecedents.
Having considered the facts and the circumstances of the case, the provisional anticipatory bail granted to the petitioners vide order dated 08.04.2019 passed by a Bench of this Court is, hereby, confirmed.
