The petitioner apprehends his arrest in connection with Jhajha P.S.Case No. 19/2012 registered for offences punishable under Sections 420, 120 (B)/34 of the Indian Penal Code. The prosecution case is that on 8th October, 2011, one Vijay Kumar informed the informant through his mobile at about 10.A.M. that the informant's Vodafone Mobile number had won a sum of Rs. Ten lakhs and to claim that amount, informant has to deposit Rs. 12, 650/- in the account of Mr. Surendra Yadav, so that the informant gets the said amount and, accordingly, informant deposited the said amount in the account of Surendra Yadav. Vijay Kumar again called the informant on his mobile that tax due on account of this lottery, should be deposited in the
Patna High Court Cr.Misc. No.51157 of 2015 (2) dt.10-12-2015 2/2 account of Mr. Deepak Kumar, petitioner and Sajid Usman. It has been submitted by the learned counsel for the petitioner that co-accused Surendra Yadav in whose account a sum of Rs. 12, 650/- was deposited, has already been granted privilege of regular bail from the Court below.
It has further been submitted by the learned counsel for the petitioner that the petitioner has no criminal antecedent, as is evident from para- 3 of the petition.Furthermore, it has been submitted that not a single amount has been deposited in the account of the petitioner.
Be that as it may, let the above named petitioner in the event of his arrest or surrender before the Court below within a period of six weeks from today be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Jhajha P.S.Case No. 19/2012, subject to the conditions as laid down under Section 438(2) of the Cr. P. C.
