JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 10-07-2020 In view of the submission and undertaking of the learned counsel for the petitioners, at the time of hearing of this application through Video Conferencing, that he would remove the defect(s), as pointed out by the office vide its notes dated 01.07.2020, within two weeks of starting of the Court proceeding in physical mode, he is permitted to remove the same accordingly.

Heard learned counsel for the petitioners and the learned A.P.P. for the State through Video Conferencing. The petitioners seek bail in connection with Habeli Kharagpur P.S. Case No.24 of 2020/G.R. No.178 of 2020 registered under Section 392 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioners submits that it would appear from the F.I.R. that the petitioners are

Patna High Court CR. MISC. No.21551 of 2020(2) dt.10-07-2020 2/2 not named in the F.I.R. and the name of the petitioners surfaced in this case on the basis of their own confessional statements. Except that, nothing has been collected by the Investigating Officer in course of investigation to show the involvement of the petitioners in this case. The petitioners have no criminal antecedents and are in custody since 11.02.2020. On investigation, the police has already submitted the charge-sheet against the petitioners. Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-IV, Munger, in connection with Kharagpur P.S. Case No.24 of 2020.
