Petitioner is in custody in connection with Excise Case No. 946 of 2018 for the offence under section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. He is in custody since 29.10.2018.

He further submitted that nothing was recovered from the physical possession of the petitioner or the dicky of the vehicle of the petitioner.

Considering the fact that petitioner has no criminal antecedent and he is in custody since 29.10.2018, let the
