The petitioner, who is in custody, seeks bail in connection with Danapur P.S.Case No. 377 of 2014 registered under Sections 399, 402 and 414 of the Indian penal Code and Sections 25(1-B)(a), 26 and 35 of the Arms Act. Prosecution case, in brief, is that police apprehended five persons alleging that they had assembled and making plan for committing dacoity. It is also alleged that one mobile phone was recovered from the possession of the petitioner. Learned counsel for the petitioner submits that allegation is false and fabricated. The petitioner has clean antecedent and only a mobile phone was recovered from his possession and no any incriminating article was recovered and he

Patna High Court Cr.Misc. No.55012 of 2016 (2) dt.21-12-2016 2/2 has been in custody since 04.09.2016.

Considering the aforementioned facts and circumstances, the petitioner, named above, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Danapur in connection with Danapur P.S. Case No. 377 of 2016.
