The petitioners are apprehending their arrest in connection with Islampur P.S.Case No.36 of 2019 registered for offences punishable under Section 22 of the N.D.P.S. Act. Allegation against the petitioners is about recovery of o1 kg. Ganja from the under-construction house of the petitioner. Submission of the learned counsel for the petitioners is that they are not residing in that house and they have falsely been implicated and they have no criminal antecedent as well as the recovery is less than the commercial quantity. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner surrender

Patna High Court CR. MISC. No.23567 of 2019(3) dt.14-05-2019 2/2 before the learned court below and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by the order of this Court. With the aforesaid direction, this application is dismissed.
