The petitioner has preferred this application for grant of regular bail in a case registered under sections 304B and 34 of the Indian Penal Code.

As per the prosecution case, the daughter of the informant who was married to the younger brother of the petitioner herein was done to death for non-fulfillment of demand of dowry by way of a mobile and a motorcycle. It is submitted by learned counsel for the petitioner that the petitioner who happens to be the bhaisur (elder brother of the husband) of the deceased has been falsely implicated in the case. He was living separately and has no connection with his younger brother and his family. He is in custody since

Patna High Court CR. MISC. No.32064 of 2021(2) dt.23-12-2021 2/2 19.1.2021 and father-in-law of the deceased has been enlarged on anticipatory bail vide order dated 8.8.2019 (Annexure-3) passed in Cr. Misc. no. 35638 of 2019.

Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for more than 11 months, the Court directs the petitioner to be enlarged on bail in connection with Adapur P.S. Case no. 308 of 2018 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Raxaul, Motihari, East Champaran.
