JUSTICE SUDHIR SINGH ORAL ORDER 08-12-2016 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case instituted under Sections 147, 148, 149, 341, 323, 337, 332, 333, 353,427, 156, 295A and 295 of the Indian Penal Code.
Allegation against petitioners is that they were members of the mob, who violated law and order and threw stones at the peace march party and police personnel.
It has been submitted on behalf of petitioners that they are in custody since 13.10.2016. They have got no criminal antecedent. No allegation of tampering of witnesses is alleged against petitioners. Altogether 47 persons have been made accused including petitioners. No specific allegation has been made against petitioners. General and omnibus allegation has been made against petitioners. Other co-accused have been granted bail vide Cr. Misc. no. 50877 of 2016 and Cr. Misc. no. 51083 of 2016.
Patna High Court Cr.Misc. No.52600 of 2016 (2) dt.08-12-2016 2/2 On behalf of the State, it is submitted that petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned 1st Class Judicial Magistrate, Udakishunganj, Distt.
