Mr. Binod Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 06-03-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

After going through the earlier order dated 19.12.2017 passed in Cr. Misc. No.61977 of 2017, it is evident that considering the plea of juvenile, the petition was disposed of directing the learned lower Court to proceed accordingly, in case, prayer is made at the end of the petitioner. It has been submitted at the end of the petitioner that petitioner has not been identified juvenile against which, revision is pending. Also submitted that it happens to be a case registered under Section 376/ 511 of the I.P.C., whereupon considering the period of detention, petitioner be released on bail.

The learned Additional Public Prosecutor opposed the

Patna High Court CR. MISC. No.78058 of 2018(2) dt.06-03-2019 2/2 prayer.

Petitioner has supported the prayer by way of filing of compromise petition. That being so, the learned lower Court will dispose it of soon after examination of the victim and other charge sheet witnesses, if any, more preferably within one month from the examination of the victim.
