JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 17-12-2015 A counter affidavit has been filed on behalf of the respondent authorities of the Health Department, Government of Bihar. The issue relates to non-appointment of the petitioner on tenure post of Senior Resident in the Medical Colleges and Hospitals of the State of Bihar. What ever has been asserted in the writ application is not required to be taken note of in view of the stand of the respondents in the counter affidavit where they do accept in para 6 that petitioner was wrongfully excluded in the final merit position as less merit point was given to him. This position now stands rectified and the authorities expect to take a decision in this regard as a follow-up measure very soon.

Writ application stands disposed of with a direction upon the Principal Secretary, Department of Health, Government of Bihar that the corresponding notification in relation to the petitioner must be issued within a period of four weeks from today.
