The petitioner seeks bail in Kharagpur P.S. case No. 297 of 2018 registered under Section 399/400/402 of the Indian Penal Code and under Section 25(1-b) a/26/35 of the Arms Act. The police raided a place on the information that criminals had assembled to commit offence and arrested two persons, namely, Chhotu Yadav and Jyotish Bind, the petitioner. From the possession of Chhotu Yadav one country made pistol with live cartridges were recovered. From the possession of the petitioner one magazine containing four live cartridges was recovered.
The learned counsel for the petitioner submits that for recovery of four live cartridges the petitioner is in jail since 13.09.2018. The petitioner has got no criminal antecedent.
Patna High Court Cr.Misc. No.73631 of 2018(3) dt.17-12-2018 2/2 House of the petitioner is situated near the place of occurrence that is why the petitioner has been implicated in the case. Taking into consideration the fact that petitioner has got no criminal antecedent and for recovery of four live cartridges the petitioner has remained in jail for more than three months, the petitioner, above named, is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the lime amount each to the satisfaction of Sri Jitendra Kumar, learned Additional Chief Judicial Magistrate-IV, Mungr in connection with Kharagpur P.S. case No. 297 of 2018.
