JUSTICE BIRENDRA KUMAR ORAL ORDER 19-07-2018 The judgment of both the courts below is in favour of Ram Janki Deities situated at Nadraganj, Gaya. The suit was filed by the aforesaid legal person through its Mahant Ramanuj Das. After death of Ramanuj Das, rightly or wrongly his son and daughter were substituted. Thereafter, vide order dated 18.06.2018 four weeks' peremptory time was allowed to the appellant for filing requisites of notice against the substituted legal heirs. The appeal has already been dismissed for non-compliance of the peremptory order of the Court. Since judgment of the court below is in favour of Respondent No.1, no interference can be made in the said judgment unless the legal representative has opportunity of being heard. Therefore, the whole appeal would abate.
Accordingly, this appeal stands dismissed as abated. (Birendra Kumar, J) abhishek/- U
