The petitioner seeks bail in a case registered under Sections 413/ 414 of the Indian Penal Code.

Allegedly, the petitioner was apprehended by the police with stolen motorcycle.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 25-12-2017. Charge sheet has already been submitted. Earlier prayer for bail of the petitioner was rejected with observation "presently rejected" and a direction was given to the court below to conclude the trial of

From perusal of the report, it transpires that charge has been framed. The petitioner is in custody since 25-12-2017. The petitioner had no knowledge that the motorcycle in question is a stolen property. There is no likelihood of the case being concluded in near future. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate (West), Muzaffarpur in connection with Kanti P.S.
