2. The petitioner seeks bail in connection with Malaypur P.S. case No. 14 of 2024 instituted for the offences under Sections 147, 148, 149, 341, 323, 307, 379, 504 of the Indian Penal Code.

3. Prosecution case, in short, is that on the alleged date and time of occurrence, all the FIR named accused persons armed with weapons started abuseing the informant. It is further

Patna High Court CR. MISC. No.28239 of 2024(2) dt.19-04-2024 2/3 alleged that this petitioner assaulted the informant with butt of the pistol on his head with intention to kill him.

4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. Learned counsel further submitted that petitioner was having no intention to kill the informant. There is case and counter-case between the parties. Learned counsel further submitted that both sides sustained injuries including the petitioner and the informant. He further submitted that injury sustained by the informant is grievous in nature. It has been submitted on behalf of the petitioner that the petitioner is in custody since 19.02.2024 and has two criminal antecedents and he is on bail in both the cases.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case and the fact that there is case and counter-case between the parties and both sides have sustained injuries as also the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of
