JUSTICE RAKESH KUMAR ORAL ORDER 01-07-2017 Heard Sri Jitendra Kumar Singh, learned counsel, assisted by Sri Anil Kumar, learned counsel for the petitioners and Smt. Asha Devi, learned Additional Public Prosecutor. Two petitioners, who are Panchayat Secretary and Mukhiya respectively, have approached this court for grant of anticipatory bail in Arwal P.S. Case No. 242 of 2016 registered for the offence under section 419, 420, 467, 468, 471 and 120B of the Indian Penal Code in the event of their arrest or surrender. Against them there is allegation that they were instrumental in appointment of Panchayat Teacher on the basis of forged certificate.

Learned Additional Public Prosecutor has opposed the

Patna High Court Cr.Misc. No.21852 of 2017 (2) dt.01-07-2017 2/2 prayer for grant of anticipatory bail.

Considering the nature of accusation, there is no need to extend the privilege of anticipatory bail to both the petitioners. Accordingly, the prayer for anticipatory bail stands dismissed.
