The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 379, 307, 504 and 506 of the Indian Penal Code.
It is alleged that the accused persons including the petitioner entered into the house of the informant, the petitioner caught hold the hair of the wife of the informant and co-accused Alakh Yadav took way earring and cash of rupees twenty five thousand from the box. The petitioner assaulted the informant with the butt of the pistol and co-accused
Patna High Court Cr.Misc. No.45028 of 2015 (2) dt.02-11-2015 2/2 Alakh Yadav assaulted the wife of the informant with pistol when other accused persons also assaulted the informant. It is submitted by learned counsel for the petitioner that the injury of the informant on left parietal region has been found to be simple in nature. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Moreover, other accused persons have been granted anticipatory bail vide Cr. Misc. No. 44287 of 2015. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Chandi (Wena) P.S. Case No. 182 of 2015 pending in the court of learned Judicial Magistrate, Ist Class, Hilsa, Nalanda.
With the aforesaid observation, this application is disposed of.
