The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 307, 323 and other allied sections of the Indian Penal Code. As per the prosecution case, petitioner no. 1 assaulted the informant with lathi causing head injury. When Manish Kumar and Shivam Kumar came to save the informant, petitioner nos. 2, 3 and 4 assaulted both of them with iron rod causing injury on the head of Shivam Kumar and left hand of
Patna High Court CR. MISC. No.23347 of 2023(2) dt.26-06-2023 2/2 Manish got fractured. The accused persons also snatched cash of Rs. 49,000/-. The accused persons also demanded ransom of Rs. 01 lakh.
It is submitted that on account of pending land dispute between the parties a simple occurrence of Marpit took place. The doctor has found the injury sustained by the injured simple in nature. Allegation of demand of extortion is false, as no amount has been delivered to the petitioners. Petitioners claim clean antecedents.
Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate I, Udakishunganj, Madhepura in connection with Udakishunganj P.S. Case No. 423 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
